These terms govern your use of mireskashop.com and any purchase you make from it. The site is operated by Shawn Dronyk, operating as mireskashop.com ("we", "us", "our"), of 97 Hagerman Cres, Ontario, Canada.

By browsing the site or placing an order you agree to these terms. If you don't agree, please don't use the site.

1. Eligibility

You must be at least the age of majority in your province, state, or country to purchase, or have the consent of a parent or guardian. You agree to provide accurate and complete information when you order.

2. Products

We do our best to display our products accurately, but colours and detail vary between screens, and packaging and appearance may differ slightly from the images shown. Product descriptions, pricing, and availability may change without notice.

We may limit quantities per customer, per household, or per order, and we may discontinue a product at any time.

3. Orders, pricing, and payment

All prices are shown in CAD and exclude taxes and shipping unless stated. Applicable taxes are calculated and shown at checkout.

Placing an order is an offer to buy. We accept your offer when we send an order confirmation. Until then, no contract exists between us.

We may refuse or cancel any order, including after a confirmation has been sent, where:

the product is out of stock or was priced or described incorrectly
we suspect fraud, resale, or an unauthorised transaction
we can't ship to your address
you have breached these terms

If we cancel an order you've already paid for, we refund you in full to your original payment method.

Obvious pricing errors

If a product is listed at an obviously incorrect price and you could reasonably have recognised it as an error, we may cancel the order and refund you rather than honour the listing.

4. Shipping, returns, and refunds

Delivery timelines, costs, customs charges, and risk of loss are set out in our [Shipping Policy]. Returns, refunds, and exchanges are set out in our [Refund & Returns Policy]. Both are part of these terms.

5. Product use and health

Our products are cosmetics. They are not drugs, and they are not medical devices. Nothing on this site is medical advice, a diagnosis, or a treatment recommendation.

Read the packaging before use, patch test if you have sensitive skin, and stop using the product if you experience irritation. If you have a skin condition, are taking prescription acne medication, are pregnant or breastfeeding, or have any doubt, speak to a physician, dermatologist, or pharmacist first.

6. Accounts

If you create an account, you're responsible for keeping your password confidential and for activity under your account. Tell us immediately at support@mireskashop.com if you think it's been compromised. We may suspend or terminate an account that breaches these terms.

7. Acceptable use

Don't use the site to break the law, infringe anyone's rights, transmit malware, scrape or harvest data, interfere with the site's operation, or attempt to gain unauthorised access to any part of it. Don't buy from us for commercial resale without our written permission.

8. Your content

If you post a review, comment, photo, or other content, you keep ownership of it, but you grant us a non-exclusive, worldwide, royalty-free, transferable licence to use, reproduce, adapt, and display it in connection with our business, including in advertising, without further compensation or attribution.

You confirm your content is yours to share, is accurate, doesn't infringe anyone's rights, and isn't unlawful, defamatory, or obscene. We may remove any content at our discretion, but we're not obliged to monitor it.

9. Intellectual property

The site and everything on it — text, images, graphics, logos, design, and the mireskashop.com name — belongs to us or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, or use it commercially without our written permission.

10. Third-party links and services

The site may link to or rely on third-party services. We don't control them and aren't responsible for their content, policies, or practices. Review their terms before using them.

11. Disclaimer of warranties

The site and our products are provided on an "as is" and "as available" basis. To the fullest extent the law permits, we disclaim all warranties that aren't expressly stated, including implied warranties of merchantability and fitness for a particular purpose.

Nothing in these terms excludes or limits any warranty, condition, or remedy that cannot be excluded under applicable consumer protection law, including Ontario's Consumer Protection Act, 2002 and the Sale of Goods Act. If you are a consumer, you keep every statutory right those laws give you.

12. Limitation of liability

To the fullest extent the law permits, our total liability arising out of or relating to your use of the site or any product is limited to the amount you paid for the product in question.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data.

Again, nothing here limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection legislation.

13. Indemnity

You agree to indemnify us against claims, losses, and reasonable legal costs arising from your breach of these terms, your misuse of the site, or your violation of any law or third-party right.

14. Governing law and jurisdiction

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute, and you consent to that jurisdiction.

If you are a consumer resident in another province, state, or country, this clause does not deprive you of the protection of mandatory consumer law in your place of residence, or of your right to bring proceedings there where that law says you may.

15. Complaints and resolution

If something has gone wrong, email support@mireskashop.com first. We aim to resolve complaints within 24 hrs and we'd much rather fix a problem directly than have you go through your bank. Filing a chargeback without contacting us first slows down a resolution for everyone.

16. Changes to these terms

We may update these terms at any time by posting a revised version with a new date. Changes are not retroactive. The version in effect when you placed your order governs that order.

17. General

If any provision is found unenforceable, the rest stays in force. Our failure to enforce a provision isn't a waiver of it. These terms, together with our policies, are the entire agreement between us regarding the site.
